Snipes Loses Appeal; ClubFed Is on the Horizon

July 16th, 2010 admin

Remember Wesley Snipes? The actor was convicted of three misdemeanor tax charges but has been free on bail while waiting for the 11th Circuit Court of Appeals to decide his appeal. Bad news for Mr. Snipes: “After thorough review, we affirm the rulings and judgment of the district court in all respects.” The Appellate Court decision is available here. There’s nothing humorous in the decision, just a terse shoot-down of all of Mr. Snipes’ arguments. The most interesting part of the decision is the Court noting that misdemeanors can be just as serious as felonies, and it’s the amount of the tax loss that impacts sentencing. The district court noted that misdemeanants who, like Snipes, had willfully failed to file …

Government to Snipes: It’s Time to Head to ClubFed
With the recent ruling from the Court of Appeals denying Wesley Snipes’ appeal of his three misdemeanor tax convictions , the US Department of Justice has asked that Snipes head to ClubFed now . Mr. Snipes’ attorneys plan on responding to this shortly. In any case, Mr. Snipes should not plan on being in any movies in the next year or...
The “I Was Kidnapped” Defense to Tax Evasion
If you’re accused of tax evasion, there are a myriad of good defense strategies. However, claiming you were kidnapped by IRS Agents isn’t one of them. Judge William Terrell Hodges rejected that claim along with several others made by Mark Maggert. If the judge’s name sounds familiar, it should; Judge Hodges presided over the Wesley...
A Loss for the Taxpayer but a Win for Gamblers
The Tax Court today looked at the case of a couple who gambled in their local casino, won, but didn’t include the income on their tax return. That they had taxable income is a given, but there’s a very interesting and useful aspect of the decision. During 2005 the taxpayers gambled on the slots at their local casino in Charles Town, West...
It’s Unpopular, Unworkable, and Insane, So Naturally They’re in a Hurry to Pass It
So I noted last month (more accurately, noting that Joe Kristan’s comment was completely accurate). We have a new listing of the taxes in the healthcare legislation. The new taxes are noted by italics while taxes that have been removed are noted by strikeout text. 1. Individual Mandate Tax. For those who don’t purchase health insurance, this...
Thank You, George Cohan: A Gambler Gets Lucky
George Cohan is known as “the man who owned Broadway.” He also proved quite helpful to a gambler today at the US Tax Court. Jose Caro liked horse racing. Any and every day he could, he went to the track and bet on the races. Sometimes he won, but for the most part he lost. He also has had experience dealing with the IRS. Some time ago...
Must a Practitioner Audit a Client’s Financials?
The IRS today released IR-2010-82 noting the disbarment of CPA Tim Kaskey for, “finding, among other things, that Kaskey failed to exercise due diligence in preparing tax returns for a corporation and its husband and wife shareholders.” Here’s the key paragraph from the announcement: When Kaskey failed to respond, or appear, at...
On working with felons
I have been criticized on many occasions for working with felons in my fraud investigation practice. Specifically, I have been working with Barry Minkow and Sam Antar for over three years on a variety of fraud investigations. Both are convicted felons for their participation in large-scale financial frauds in the 1980s. I work with others convicted...
Uh, Wesley, Your Guru Just Got 20 More Years
Wesley Snipes is still fighting his upcoming visit to ClubFed. The troubles he got into are all courtesy of his tax guru, Eddie Kahn. Mr. Kahn received ten years at ClubFed for his ‘advice’ to Mr. Snipes. He just got 20 more years for conspiracy to defraud and mail fraud. Joe Kristan has more.  Read More →
Traficant Running
My friend Scott reminded me that I should let everyone know that Jim Traficant has thrown his hat in the ring . He’s running as an independent in Ohio’s 17th Congressional District. Tim Ryan, a Democrat, currently is the Congressman in that district. The district includes Youngstown, Niles, Warren, and Kent. Mr. Traficant has stated that...
